Dennoch. Da es bei uns sowas nicht gibt, gibt es für Polizisten einen Anreiz, eine illegale Hausdurchsuchung durchzuführen, die dann nachträglich durch die gefundenen Beweise moralisch gerechtfertigt wird. Ist natürlich nur doof, wenn man dann nichts findet.
Warum ich das gerade alles erzähle? Der Supreme Court von Irland hat gerade diese Doktrin für Irland abgeschafft. Das ist eine große Katastrophe, wenn ihr mich fragt. Besonders krass:

That provision was struck down by the Supreme Court in Damache v DPP [2012] IESC 11. Strictly speaking, therefore, any evidence obtained pursuant to the warrant was unconstitutionally obtained.
