In 2000, High Court judges ruled that Chagossians could return to 65 of the islands, but not to Diego Garcia.In 2004, the government used the royal prerogative - exercised by ministers in the Queen's name - to effectively nullify the decision.
Last year, the court overturned that order and rejected the government argument that the royal prerogative was immune from scrutiny. The government had asked the Lords to rule on the issue.
Royal Prerogative? Da zieht es mir ja die Schuhe aus. WTF?! Ein Hoch auf den High Court, dass die diesen Scheiß nicht einfach gefressen haben. Un-faß-bar. Aber wie gesagt hat die Politik reagiert, indem sie einen noch höheren Gerichtshof geschaffen haben, den Supreme Court of the United Kingdom. Nun gibt es diesen Supreme Court noch nicht, und solange übernimmt halt direkt das Oberhaus. Gewaltenteilung? Brauchen wir hier nicht. Die Regierung entscheidet darüber, ob sie selbst legal gehandelt hat oder nicht. Was kann da schon schief gehen.
